Selling Contract

Purpose Article 1- The purpose of this Regulation is to regulate the implementation procedures and principles about distance contracts.

Scope Article 2- This Regulation applies to contracts made in writing, visual and electronic media or using other means of communication and without confrontation with consumers, for which the goods or services are decided to be delivered or executed immediately or later.

Basis Article 3- This Regulation has been prepared on the basis of Article 31 of the Law on the Protection of Consumers dated 23/2/1995 and numbered 4077 and articles 9 / A added to this Law with the Law numbered 4822.

Definitions Article 4- In the implementation of this Regulation; a) Ministry: Ministry of Industry and Trade, b) Minister: Minister of Industry and Trade, c) Goods: Movable goods subject to shopping, immovable property for housing and holiday purposes and software, sound, image and similar informal prepared for use in electronic environment tangible goods, d) Service: Any activity other than providing goods for a fee or benefit, e) Seller: natural or legal persons offering goods to the consumer within the scope of their commercial or professional activities, including public legal entities, f) Provider: Public legal entity natural or legal persons providing services to consumers within the scope of their commercial or professional activities, including individuals, g) Consumer: Real or legal person who acquires, uses or makes use of a good or service for commercial or non-professional purposes, h) Lenders: bank, private financial institution and financing companies authorized to give cash loans, i) Distance Contract: Written, visual, telephone and electronic media A means the contracts made using a or other means of communication and without confrontation with the consumers and the delivery of the good or service to the consumer immediately or later. Preliminary Information

Article 5- The following information must be given to the consumer prior to the contractual agreement. a) Name, title, full address, telephone and other access information, if any, of the seller or provider, b) Basic features of the goods or services subject to the contract, c) Sales price of the goods or services subject to the contract, including all taxes, d) Price of the seller or provider The validity period of all promises, including e) Information on how to pay the consumers, f) Information on how to make the delivery and performance, and the amount of expenses related to it, if any, g) Information on the right of withdrawal and how to exercise this right, h) the cost of the communication routes used if there is a cost, i) the program regarding the delivery and performance dates of the goods or services subject to the contract, j) the full address, telephone and any other access information of the seller or provider, to which the consumer can communicate his demands and complaints. Written Proof of Accuracy of Preliminary Information

Article 6- The contract cannot be concluded unless the consumer confirms in writing that he obtained the preliminary information correctly and completely. In electronic media contracts, this confirmation is done electronically. The consumer must obtain written approval for the goods before the contractual subject arrives, and for services, at the latest before the execution of the contract, with prior information. Conditions Required to be Contract

Article 7- It is mandatory that the distance contract be made in writing and a copy of this contract be given to the consumer. In the contract; a) The name, title, open address, telephone and other access information of the consumer, seller or provider, b) Date of contract, c) Date and form of the delivery or performance of the good or service, d) Amount of the costs related to the delivery and performance and by whom information about the supply of the contract, e) the type or type, quantity and brand and model of the good or service subject to the contract, f) The cash sales price of the goods or service in Turkish Lira including taxes, g) Total sales price in Turkish Liras to be paid together with interest according to the term. h) Interest rate, annual rate at which interest is calculated and delay interest rate not exceeding thirty percent of the interest rate specified in the contract, i) Down payment amount, j) Payment plan, k) Legal consequences of the default of the debtor.

Right of Withdrawal Article 8- Consumer; In distant contracts related to the sale of goods, it has the right to withdraw from the contract by refusing the goods within seven days from the date of receipt without undertaking any legal and criminal liability and without showing any justification. In distant contracts regarding service delivery, this period starts on the date of signing the contract. In the contract, if it is decided to perform the performance of the service before the 7-day period is over, the consumer can use the right to withdraw until the beginning of the performance. The costs arising from the use of the right of withdrawal belong to the seller or provider. Contracts regarding the services performed instantly in electronic environment and the goods delivered to the consumer are not subject to the provisions regarding the right and withdrawal.
